EDR DATA PRIVACY REGULATIONS
Canada: No specific laws; EDR data classified as non-private diagnostics. Insurers typically obtain consent.
United States: The 2015 Driver Privacy Act restricts EDR access, establishing vehicle owners/lessees as data custodians. Seventeen states have additional EDR privacy laws: Arkansas, California, Colorado, Connecticut, Delaware, Maine, Montana, Nevada, New Hampshire, New Jersey, New York, North Dakota, Oregon, Texas, Utah, Virginia and Washington. These generally require owner consent for data retrieval with limited
exceptions.
